Terms & Conditions

These Terms & Conditions ("Terms") are a legally binding agreement between you and JenFryTalks LLC, a Maryland limited liability company ("we", "us"). By creating an account or using the Conflict Literacy Index (the "Service"), you agree to these Terms.

1. Eligibility

You must be at least 18 years old to create an account on your own. Users aged 13–17 may use the Service only with verifiable parent or guardian consent and through a school, team, or organization account. The Service is not for children under 13.

2. Accounts

You are responsible for the accuracy of your account information and for all activity under your account. Do not share credentials or seats. Notify us immediately of any unauthorized use.

3. Purchases and subscriptions

Prices are shown at checkout. You authorize us and our payment processor (Stripe) to charge your payment method. Team and organization plans may be billed annually or per seat. Taxes may apply.

4. Refunds

Refunds are governed by our Refund Policy. In short: a full refund is available within 7 days of purchase if you have not started the assessment.

5. Acceptable use

You agree to comply with our Acceptable Use Policy. Prohibited conduct includes scraping, reselling, sharing seats, reverse engineering, uploading unlawful content, or interfering with the Service.

6. Intellectual property

The Service, including the Conflict Literacy Index framework, questions, scoring model, benchmarks, copy, and design, is owned by JenFryTalks LLC and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. Your assessment answers remain yours; you grant us a license to process them to provide and improve the Service (including anonymized aggregation).

7. User content

You represent that any content you submit does not violate law or third-party rights. We may remove content that violates these Terms.

8. Third-party services

The Service integrates with third-party providers (payments, email, hosting). Their terms and privacy policies also apply. See our Subprocessors list.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Assessment results are educational guidance and are not a substitute for professional psychological, medical, legal, or clinical advice, diagnosis, or treatment.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JENFRYTALKS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$100.

11. Indemnification

You agree to indemnify and hold JenFryTalks LLC harmless from claims arising out of your violation of these Terms or misuse of the Service.

12. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms. Sections that by nature should survive (IP, disclaimers, limitation of liability, governing law) will survive termination.

13. Governing law and venue

These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state or federal courts located in Baltimore, Maryland, and you consent to the personal jurisdiction of those courts.

14. Changes

We may update these Terms. Material changes will be posted here with a new "Last updated" date. Continued use after changes means you accept the updated Terms.
